These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you” or “your”) and KAKUS ENTERPRISES PRIVATE LIMITED (GSTIN: 29AAJCK3353N1ZY) (“Company”, “we”, “us” or “our”), the operator of State Filter (the “Service”), accessible at https://statefilter.in. By creating an account, purchasing credits or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872. If you are using the Service on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

State Filter is a credit-based Software-as-a-Service (SaaS) platform that accepts CSV or Excel files containing Indian mobile numbers and returns a processed file in which the numbers are tagged or filtered by the Indian state or union territory associated with the mobile number prefix. The Service is provided on an “as-is” and “as-available” basis.

3. Accounts and Registration

  • You must provide a valid email address and accurate registration information.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must notify us immediately at admin@statefilter.in of any unauthorised use of your account.

4. Credits, Pricing and Payments

  • The Service operates on a prepaid credit system. You purchase credit packages at the prices displayed on our pricing page. All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
  • Payments are processed through third-party payment gateways including Razorpay and Stripe. Your use of these gateways is also subject to their respective terms and privacy policies.
  • Credits are deducted from your account balance only for valid Indian mobile numbers successfully processed by the Service.
  • Credits are non-transferable and have no cash value. Credits do not expire unless stated otherwise on the pricing page or package description.

5. Acceptable Use

You agree that you will not:

  • Upload any data that you do not have the lawful right to process, including mobile numbers obtained without the required consent under the Digital Personal Data Protection Act, 2023 (India) or any other applicable law.
  • Use the Service for unsolicited telemarketing, SMS spam, or any activity that violates the Telecom Commercial Communications Customer Preference Regulations (TCCCPR) or DND registry.
  • Upload malware, scripts, or files designed to harm or disrupt the Service or any other user.
  • Reverse-engineer, scrape, or circumvent rate limits or access controls of the Service.
  • Resell, sublicense, or commercially exploit the Service without prior written consent.

We reserve the right to suspend or terminate any account that we reasonably believe is in breach of these Terms, with or without notice.

6. Data, Files and Retention

  • You retain all rights, title and interest in and to the files you upload (“User Data”). You grant us a limited, non-exclusive licence to host, process and deliver User Data solely to provide the Service.
  • Uploaded and processed files are automatically deleted from our systems after 30 days, or earlier if you delete them manually.
  • We implement reasonable technical and organisational measures to protect User Data but cannot guarantee absolute security.

7. Accuracy of Results

State-to-prefix mapping is based on publicly available telecom numbering data and mobile number portability (MNP) introduces inherent uncertainty. We make no warranty that the state tag returned for any specific mobile number is current, correct or fit for a particular purpose. You are solely responsible for validating results before relying on them for any commercial or legal purpose.

8. Intellectual Property

The Service, including its source code, design, trademarks, logos and content, is the exclusive property of KAKUS ENTERPRISES PRIVATE LIMITED and is protected by applicable Indian and international intellectual property laws. No rights are granted to you other than the limited right to use the Service in accordance with these Terms.

9. Service Availability

We strive to keep the Service available 24x7 but do not guarantee uninterrupted access. Scheduled maintenance, force majeure events, third-party outages, or upgrades may cause downtime. We are not liable for any loss resulting from such unavailability.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory or otherwise, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, KAKUS ENTERPRISES PRIVATE LIMITED, its directors, employees and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of (or inability to use) the Service. Our aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount of credits paid by you in the three (3) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold KAKUS ENTERPRISES PRIVATE LIMITED harmless from any claim, demand, loss or damage (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

13. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your account for breach of these Terms, non-payment, or for any legal or regulatory reason. Upon termination, your right to use the Service ceases immediately. Unused credits are governed by our Refund & Cancellation Policy.

14. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified to you by email or by a prominent notice on the Service. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Karnataka.
